Agreement

These Terms of Service ("Terms") govern your access to and use of the Concord website and the public Concord Index (collectively, the "Services") offered by Concord ("we" or "us"). By browsing the site, requesting a Concord Index report, contacting us, or otherwise using the Services, you agree to these Terms for yourself and, if applicable, the organization you represent.

The Services

The Concord Index is a public, source-backed comparison of documented company commitments with measured AI model answers under a published protocol. Visitors may browse published reports, explore the model questions and methodology, compare their own answers in the browser, request a report for a company, and contact Concord. Features and availability may change over time.

Public Concord Index

The Index publishes source-backed reports for listed companies. Concord may collect and quote attributable public sources, create a versioned report, and publish qualifying reports. You may submit a correction from a report or through the contact form.

The Concord Index measures agreement between supported company positions and observed model answers under the stated protocol. It is not an endorsement, safety rating, psychological assessment, employee fit score, or recommendation that a company use a particular model. Public sources, model behavior, and provider configurations can change, so reports may become outdated.

Visitors may request a Concord Index report by leaving a work email and a company name or website. Concord reviews each request and may run the research manually. Nothing is generated live on the site, and a request does not guarantee that a report will be produced or published. If Concord later requires a matching work-email confirmation for a request, that confirmation shows access to that mailbox. It does not show that you are authorized to speak for the company, approve a public statement, or bind the company to these Terms.

Visitor submissions

When you request a report or send a contact message, you are responsible for the accuracy of the information you provide and for having the right to submit it. Do not submit passwords, API keys, confidential workplace material, or other secrets through public forms.

Acceptable use

You agree not to:

• Use the Services in violation of law or third-party rights, or to harm individuals or organizations.
• Attempt to probe, scan, or test the vulnerability of the Services, or breach security or authentication measures.
• Reverse engineer, decompile, or disassemble the Services except where applicable law prohibits this restriction.
• Use the Services to build a competing product or train general machine-learning models on Concord's proprietary materials without permission.
• Upload unlawful content, malware, or material you do not have rights to use.
• Use the Concord Index to harass individuals, infer private political beliefs, assess employees or candidates, or submit private systems or confidential source material.

Third-party services and model outputs

The Services may rely on hosting, search, analytics, email, and AI providers. Their availability and behavior can affect the Services. AI and search outputs may be incomplete, inconsistent, or wrong. You must evaluate outputs and retain accountable human review for material decisions.

Intellectual property

Concord and its licensors own the Services, including software, text, graphics, and branding, subject to the rights granted to you in these Terms. Public Index sources remain the property of their respective owners. No rights are granted except as expressly stated.

Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, Concord disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Concord does not warrant that public sources or AI-related outputs will be complete, current, accurate, safe, or suitable for any specific decision. A Concord Index score does not establish model quality, compliance, cultural fit, or operational suitability. Human judgment remains your responsibility.

Limitation of liability

To the fullest extent permitted by law, Concord and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Concord's aggregate liability for claims arising out of or related to the Services will not exceed the greater of one hundred U.S. dollars (US$100) or the amount you paid Concord for the Services during the 12 months before the claim, unless a signed agreement sets a different cap.

Indemnification

You will defend, indemnify, and hold harmless Concord and its affiliates from claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Services, content you submit, or violation of these Terms. We will defend and indemnify you from third-party claims that the Services infringe that party's U.S. intellectual-property rights, except to the extent a claim arises from content you submit, your modifications, combinations with non-Concord products, or use that violates these Terms.

Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms or if required to comply with law or protect the Services. Provisions that by their nature should survive will survive termination.

Changes

We may update these Terms. We will post revised Terms and update the date above. For material changes, we will provide additional notice when appropriate. Continued use after the effective date may constitute acceptance to the extent permitted by law.

Governing law and disputes

These Terms are governed by Delaware law, without regard to conflict-of-laws rules. The parties agree to exclusive jurisdiction and venue in the state and federal courts located in New Castle County, Delaware, and waive objections to those courts on personal jurisdiction or venue grounds.

Miscellaneous

If any provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Concord for the Services described here. You may not assign these Terms without our prior written consent.
